Service overview
Legacy365 Insurance is a Medicare field marketing organization (FMO) providing recruiting, contracting support, training, lead distribution, and business tools to independent insurance agents.
Independent contractor relationship
Agents who work with Legacy365 are independent contractors, not employees. Nothing in these terms, the portal, or any related materials creates an employment, partnership, agency, joint venture, or fiduciary relationship between you and Legacy365. You are responsible for your own licensing, taxes, appointment fees, business expenses, and regulatory compliance.
Electronic communications
By creating an account, you agree to receive transactional and account-related electronic communications from us — including notices, updates, and administrative messages — even if you have opted out of marketing communications.
Permissible use and prohibited conduct
The portal, training materials, recordings, and lead data are provided for your own business use in connection with Legacy365 only. You agree not to:
- Share your credentials or portal access with any other person.
- Copy, redistribute, or republish training materials or session recordings.
- Share, sell, or resell lead data.
- Record training sessions or meetings without permission.
- Attempt to gain unauthorized access to our systems or data.
- Upload malicious code or interfere with the operation of the platform.
- Misrepresent your affiliation with Legacy365 Insurance.
Lead data
Leads provided by Legacy365 remain confidential and may be used only by the assigned agent, and only for Legacy365 business. Leads may not be sold, shared, or retained after your relationship with Legacy365 ends. You are responsible for complying with the Telephone Consumer Protection Act (TCPA), Do-Not-Call (DNC) requirements, and all applicable CMS marketing rules when contacting leads.
Intellectual property
All training content, recordings, tools, branding, and platform materials are the property of Legacy365 Insurance. We grant you a limited, revocable, non-transferable license to use these materials for your personal professional use in connection with Legacy365 business only. You may not copy, distribute, modify, or resell any of these materials.
Training sessions and recordings
Training sessions, bootcamps, and meetings may be recorded. Your participation constitutes consent to recording. Recordings are made available for your personal review and may not be shared, republished, or distributed in any form.
Third-party services
We use third-party platforms to deliver our services, including Zoom, email delivery services, e-signature and document tools, and analytics providers. Those services are governed by their own terms, and we are not responsible for their outages, errors, or acts and omissions.
Compliance responsibility
You must follow all applicable CMS regulations, carrier marketing guidelines, state insurance laws, and TCPA/DNC requirements in your business. Legacy365 provides tools and training to support compliance, but you remain solely responsible for your own compliance obligations.
Disclaimers
Legacy365 Insurance is not affiliated with, endorsed by, or approved by the Centers for Medicare & Medicaid Services (CMS), Medicare, or any government agency. Nothing on the website or portal constitutes legal, tax, or compliance advice. Income and production results are not guaranteed; your results depend on your own effort and performance. The website, portal, and services are provided "as is" and "as available," without warranties of any kind, express or implied.
Limitation of liability
To the fullest extent permitted by law, Legacy365 Insurance and its owners, officers, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost commissions, or lost data, arising out of or related to your use of the website or portal. Our total liability for any claim arising from these terms or your use of the services is limited to the greater of one hundred dollars ($100) or the amounts, if any, that you paid to us for the services giving rise to the claim in the twelve months preceding the claim.
Governing law and dispute resolution
[Placeholder — governing state and dispute resolution terms (arbitration, venue, jury waiver) to be determined.]
Termination
We may suspend or terminate your account and access to the portal at any time for violations of these terms or for conduct that harms Legacy365, its agents, or its partners. You may close your account at any time by contacting us. Provisions that by their nature should survive termination — including those concerning lead data, intellectual property, disclaimers, limitation of liability, and dispute resolution — survive termination.
